Firstly, a video recording can appear in an administrative offense case as evidence. This right is reserved for you in the Code of Administrative Offenses.
Remind the traffic police officer of this if he refuses to take into account the fact of the video recording of the incident. And its value is great! After all, often, in a controversial situation, such a record can become the only objective source of information, which cannot be said about the testimony of drivers, passengers, traffic police officers, who, perhaps not out of malice, but being in a state of shock, cannot adequately describe a traffic accident. .
That is why pay special attention to ensuring that your video is given legal status. Remember: the court's assessment of the video recording will be much higher if there is a DVR in your car immediately at the scene of the accident. Otherwise, your money for the purchase of the device will be wasted! Simply because even a very high-quality video is difficult to tie to a specific place and incident. And if it pops up after the fact, as they say, then it will cause much less confidence! This may give the judge the idea of tampering with evidence.
In view of this, the protocol should record the fact, if not the seizure (more on that later), then at least the presence of video information. The protocol must also reflect the manufacturer, the model of the recording equipment, the orientation of the camera and the type of media. If the latter has unusual signs, such as a scratch, it is better to write them down. Yes, and the default settings will also come in handy. The entry may look like this: "Transcend blue SD (microSD) 8 GB memory card".
Always make sure that the time that the car DVR puts on the records is correct, otherwise there will be problems with the "evidentiary weight" of your record.
Now you need to decide whether to give the record into the hands of law enforcement officers or not. If so, then it is better to do this in the presence of witnesses, indicating in the protocol the fact of transfer, the data of witnesses, and it is better to seal the card itself in an envelope.
But there is always a possibility that the card can be "lost", "broken", "formatted", etc. So if you can't make a copy before transferring the record, i.e. immediately on the spot (for example, you have a laptop with you), it is better to keep it to yourself. It doesn’t matter if you have the record or if it lies with the inspector in integrity, the court will appoint a technical examination that will establish the authenticity of the record.
What actions should you take if the inspector refuses to record the fact that there is a video recording? In this case, use your right to the full and write in your explanations about the presence of a registrar, indicate the inspector's refusal to make an entry in the protocol and your disagreement with such actions of the traffic police officer.
